By selecting the “Release of Liability” checkbox linked to this document on the registration form, I, as the parent or guardian of the child (“Participant”) enrolled in the music Program (“Program”), acknowledge and agree to the following terms for my child’s participation in the music program and related events offered by Skunk Rock LLC (“Company”).
In consideration of my child’s participation in the music program and related events (“Program”) offered by the Company, I, as a parent/guardian, acknowledge, understand, and agree as follows:
Acknowledgment of Risks: I recognize that participation in the Program involves certain risks, including but not limited to physical injury, emotional stress, and damage to property. These risks may arise from the activities themselves, the acts of others, or the unanticipated acts of the minor.
As the parent/guardian, I acknowledge and understand the following risks associated with my child’s participation in the Program. Risks may include, but are not limited to, any of the following:
- Physical Strain and Injuries: Muscle strains, repetitive stress injuries, accidents during physical activities such as playing instruments, running, or using equipment like trampolines.
- Hearing Risks: Exposure to loud music or sounds in environments where music is amplified, potentially leading to hearing damage.
- Emotional and Psychological Stress: The stress and pressure associated with performances, rehearsals, or learning new skills.
- Environmental Hazards: Risks present in the physical environment, such as tripping hazards in rehearsal spaces or outdoor areas.
- Group Activity Risks: Risks inherent in group activities, including accidental collisions or injuries.
- Property Damage: The potential for damage to personal property, instruments, or equipment.
- Health-Related Risks: Risks for participants with pre-existing health conditions or those arising from physical exertion, illness, or any other health-related issue.
I understand that this list of risks is not exhaustive and that other unforeseen risks may arise during my child’s participation in the Program. I agree to assume full responsibility for any such risks, both known and unknown.
Assumption of Risk and Responsibility: I willingly assume all risks associated with my child’s participation, both known and unknown, even those arising from the negligence of the Company, its associates or others( “Associates”), and assume full responsibility for my child’s involvement in the Program.
Release and Waiver: I hereby release, discharge, and agree not to sue the Company, its officers, employees, agents, volunteers, and other children taking the program (“Participants”) from all liabilities, claims, actions, damages, costs, or expenses of any nature arising out of or related to my child’s participation in the Program. This release also extends to my own presence or participation, as well as that of any individuals I bring or associate with, including other children, friends, relatives, and guests in any activities related to the Program, whether on the Company’s premises or at any other location where Program-related activities occur.
Parent/Guardian Responsibility for Child’s Conduct: I, as the parent or guardian of the child participant, understand and agree that I am legally and financially responsible for any harm, injury, or damage caused by my child to other participants, associates of the Company, or to the property of the Company or any other individual during the Program. This includes, but is not limited to, physical harm to another person, damage to business property or property of another participant, associate, or any other person associated with the Program. I agree to indemnify and hold harmless the Company and its Associates from any liabilities, claims, actions, damages, costs, or expenses arising out of or related to such conduct by my child.
Indemnification: I agree to indemnify and hold harmless the Company and its Associates from any liabilities, claims, actions, damages, costs, or expenses arising out of or related to my or my child’s participation in the Program.
Medical Acknowledgment and Release: I affirm that my child is in good health suitable for participation in the Program and that I will bear the costs of any medical treatment that may be necessary. I authorize the Company and its Associates to provide or seek emergency medical care for my child if necessary.
Photography, Audit & Video Release: I consent to the photographing, audio or video recording of my child and the use of these images, video and audio recordings for any legitimate purpose by the Company, including promotion, publication, distribution, marketing, communications or other purposes deemed by the owners of the business.
Agreement Scope and Territory and Jurisdiction: This waiver includes all activities, injuries, or damages that might occur during or arising out of participation in the Program, including those on the Company’s premises and during events or performances related to the Program.
I acknowledge that this waiver is broad and inclusive as per the laws of the jurisdiction where the Company operates. If any portion is held invalid, the remainder continues in full legal force and effect.
I am legally competent to sign this agreement and do so freely on behalf of my child Participant and myself.
I confirm that by selecting the “Release of Liability” checkbox on the Company registration form and submitting the form, I am electronically signing this Liability Waiver and Release in accordance with Uniform Electronic Transaction Act (UETA) and Arizona law. I understand that this electronic signature is legally binding, just as if I had signed this document in ink.
