By selecting the “Release of Liability” checkbox linked to this document on the registration form, I, as the parent or guardian of the child (“Participant”) enrolled in the music Program (“Program”), acknowledge and agree to the following terms for my child’s participation in the Program and related events offered by Skunk Rock LLC (“Company”).
In consideration of my child’s participation in the Program, I acknowledge, understand, and agree as follows:
Acknowledgment of Risks
I recognize that participation in the Program involves certain risks, including but not limited to physical injury, emotional stress, and damage to property. These risks may arise from the activities themselves, the acts of others, or the unanticipated acts of the Participant.
Risks may include, but are not limited to:
- Physical Strain and Injuries: Muscle strains, repetitive stress injuries, accidents during physical activities such as playing instruments, running, or using equipment like trampolines.
- Hearing Risks: Exposure to amplified music or loud sounds, potentially causing hearing damage.
- Emotional and Psychological Stress: Stress associated with performances, rehearsals, or learning new skills.
- Environmental Hazards: Risks from physical surroundings, such as tripping hazards indoors or outdoors.
- Group Activity Risks: Accidental collisions or injuries during group activities.
- Property Damage: Risk of damage to personal property, instruments, or equipment.
- Health-Related Risks: Exertion-related illness, aggravation of pre-existing conditions, or other health-related issues.
I understand this list is not exhaustive, and other unforeseen risks may arise during my child’s participation. I willingly assume full responsibility for such risks, known and unknown.
Assumption of Risk and Responsibility
I voluntarily assume all risks associated with my child’s participation in the Program, even those arising from the negligence of the Company, its officers, employees, agents, volunteers, or other participants (“Associates”), and assume full responsibility for my child’s involvement.
Release and Waiver of Liability
I hereby release, discharge, and agree not to sue the Company or its Associates from all liabilities, claims, actions, damages, costs, or expenses of any nature arising directly or indirectly out of my child’s participation in the Program, whether occurring on Company premises or at external locations.
This release extends to my own participation and to any individuals I bring or associate with, including siblings, friends, relatives, and guests.
Parent/Guardian Responsibility for Child’s Conduct
I accept full legal and financial responsibility for any injury, damage, or misconduct caused by my child during Program participation, whether to persons, property, or business operations. I agree to indemnify and hold harmless the Company and its Associates from all resulting claims, damages, losses, and expenses.
Indemnification
I agree to indemnify, defend, and hold harmless the Company and its Associates from any liabilities, claims, damages, costs, or expenses arising directly or indirectly out of my or my child’s participation.
Medical Acknowledgment and Release
I certify that my child is in good health and has no known medical conditions that would preclude safe participation in the Program. I accept full responsibility for any medical treatment costs that may arise. I authorize the Company and its Associates to provide or seek emergency medical care for my child as needed.
Photography, Audio & Video Release
I consent to the photographing, audio recording, and video recording of my child and authorize the Company to use these images and recordings for promotional, educational, or marketing purposes without compensation.
Agreement Scope, Territory, and Jurisdiction
This waiver covers all activities arising out of Program participation, whether conducted on-site or off-site.
This agreement is governed by and construed under the laws of the State of Arizona. Any legal action related to this waiver shall be brought exclusively in the courts located in Flagstaff, Arizona. If any part of this waiver is held invalid, the remainder shall remain in full force and effect.
Electronic Signature and Consent
By selecting the “Release of Liability” checkbox and submitting the registration form, I confirm my understanding and acceptance of this agreement. I agree that this electronic submission constitutes my legally binding signature pursuant to the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Arizona Uniform Electronic Transactions Act (UETA).
Participation in Skunk Rock LLC programs is subject to your express consent to these terms through completion of the official registration form and electronic agreement process.
